Illinois DUI Penalties

At Fagan, Fagan & Davis, we speak with many individuals who are curious about the penalties for DUI convictions.  The specific penalties will vary depending upon the circumstances of the arrest, the blood alcohol level, any previous DUI offenses on the driver’s record, and whether or not children were in the vehicle at the time of arrest.  The penalties for drunk driving in Illinois are as follows:

  • 1st conviction:  Class A misdemeanor with 0-12 months imprisonment, license suspension for approximately 1 year, 100 hours community service, fines up to $2500, may also be required to install an ignition interlock device on your car.
  • 2nd conviction:  Class A misdemeanor with 0-12 months imprisonment, fines up to $2500, required installation of an ignition interlock device on your car, and license suspension for at least 5 years if committed within 20 years of the first conviction.  If it is your second DUI conviction in a 5 year period you may be sentenced to either five days in jail or 240 hours of community service.  
  • 3rd Conviction (Aggravated DUI):  Class 2 felony with possible 3-7 years imprisonment, minimum of 10 days in jail or 480 hours community service, fines up to $25,000, license suspension for at least 10 years, and installation of an ignition interlock device on your car.
  • 4th conviction (Aggravated DUI):  Class 2 felony with possible 3-7 years imprisonment, fines up to $25,000, and lifetime loss of driving privileges.   
  • 5th conviction (Aggravated DUI):  Class 1 felony with possible 4-15 years imprisonment, fines up to $25,000, and lifetime loss of driving privileges.
  • 6th conviction (Aggravated Dui):  Class X felony with possible 6-30 years imprisonment, fines up to $25,000, and lifetime loss of driving privileges. 

In situations involving a very high blood alcohol content (.16 or higher) the penalties will exponentially increase.  To find out more specific information about the types of penalties you may face, you should speak with an attorney at our firm as soon as possible.
