The legal limit in Illinois is .08 percent, and any person found to be operating a motor vehicle with a blood alcohol content exceeding this limit can be charged with driving under the influence, or DUI.  A driver may also face DUI charges if his or her mental or physical abilities are impaired due to any amount of alcohol or controlled substance, or if he or she has taken any amount of illegal narcotic.

However, alcohol affects different people differently and it is possible that a person with a blood alcohol level of .08% or greater may still be able to operate a vehicle at a normal safety level.
